    The Individuals with Disabilities Education Act (IDEA) requires that IEP teams consider “positive behavioral interventions and supports” to address behavior impeding learning. They are also required to “review and “modify” behavioral intervention plans (BIPs) to address behavior. Yet neither the IDEA statute nor federal regulations provide guidance regarding the substantive components of a BIP. This session will feature a legal analysis of recent case law involving the development and implementation of BIPs. Five themes emerging from the analysis will be presented, with implications for IEP teams and recommendations for improving practice.

    Learner Objectives
     
    This session will help participants:
    1. Understand the requirements of the IDEA pertaining to behavioral supports and strategies.
    2. Explore recent case law that established the five themes of the legal analysis.
    3. Discuss issues involved with the development and implementation of BIPs.
    4. Prepare and present ideas for applying the learning to their professional contexts.
